Package holiday  Form for the purpose of informing the traveller in the case of a package holiday

in accordance with Section 651a of the German Civil Code  

 

The combination of travel services offered to you is a package within the meaning of Directive (EU) 2015/2302. Therefore, you can avail of all EU rights that apply to packages. The company Music Travel by JM GmbH will be fully responsible for the proper performance of the package as a whole. 
 In addition, as required by law, Music Travel by JM GmbH has protection in place to refund your payments and, where transport is included in the package, to ensure your repatriation in the event that it becomes insolvent.  
Key rights under Directive (EU) 2015/2302 Travellers receive all essential information about the package before concluding the package travel contract. At least one trader is always liable for the proper performance of all travel services included in the contract. Travellers receive an emergency telephone number or details of a contact point through which they can get in touch with the tour operator or travel agent.  
Travellers can transfer the package holiday to another person within a reasonable period and possibly at additional cost. The price of the package holiday may only be increased if certain costs (e.g. fuel prices) rise and if this is expressly provided for in the contract, and in any case no later than 20 days before the start of the package holiday. If the price increase exceeds 8% of the package holiday price, the traveller may withdraw from the contract. If a tour operator reserves the right to a price increase, the traveller has the right to a price reduction if the corresponding costs decrease. Travellers can withdraw from the contract without paying a cancellation fee and receive a full refund of all payments if any of the essential elements of the package holiday, other than the price, are significantly changed.  
 
If the trader responsible for the package cancels the package before the start of the package, travellers are entitled to a refund and compensation under certain circumstances. Travellers may terminate the contract without paying a termination fee before the start of the package in the event of exceptional circumstances, for example if there are serious security problems at the destination that are likely to affect the package.  
In addition, travellers may withdraw from the contract at any time before the start of the package holiday in return for payment of a reasonable and justifiable withdrawal fee. If, after the start of the package holiday, significant elements of the package holiday cannot be provided as agreed, the traveller must be offered suitable alternative arrangements at no extra cost.  
The traveller may withdraw from the contract without paying a cancellation fee (in the Federal Republic of Germany this right is called ‘termination’) if services are not provided in accordance with the contract and this has a significant effect on the provision of the contractual package travel services and the tour operator fails to remedy the situation.  
The traveller is entitled to a price reduction and/or compensation if the travel services are not provided or are improperly provided. The tour operator provides assistance to the traveller if they find themselves in difficulty. In the event of the insolvency of the tour operator or – in some member states – the travel agent, payments will be refunded. If the organiser or, where applicable, the retailer becomes insolvent after the start of the package and if transport is included in the package, repatriation of the travellers is secured.  
Music Travel by JM GmbH has taken out insolvency protection with R+V Allgemeine Versicherung AG. Travellers may contact this entity or, where appropriate, the competent authority (R+V Allgemeine Versicherung AG, Raiffeisenplatz 1, 65189 Wiesbaden, Tel (0611) 533-0, ruv@ruv.de) if services are denied because of the insolvency of Music Travel by JM GmbH.
